This Privacy Policy (“Policy”) explains how Boolean AI, Inc. (“Boolean,” “we,” “our,” or “us”) collects, uses, discloses, and protects information in connection with our websites, products, and services (collectively, the “Services”). Boolean builds datasets, benchmarks, and execution environments to measure and improve AI model performance on real‑world software engineering tasks.

This Policy is intended primarily for enterprise customers and their authorized users. If there is a conflict between this Policy and a written agreement between Boolean and a customer (e.g., a master services agreement, order form, or data processing addendum) (the “Customer Agreement”), the Customer Agreement controls for customer data processed under that agreement.

1. Information We Collect

1.1 Information Provided by You.

We may collect:

  • Contact and account information (e.g., name, work email, role, organization)
  • Billing and payment information
  • Customer Materials, including code, repositories, datasets, prompts, model outputs, evaluation submissions, and logs provided in connection with the Services
  • Communications and correspondence with Boolean (e.g., support tickets, emails)

1.2 Information Collected Automatically.

When you access the Services, we may automatically collect:

  • Device and usage data (e.g., IP address, browser type, operating system, access times, pages viewed)
  • Log and security telemetry (e.g., authentication events, API requests, error logs)
  • Approximate location derived from IP address

We may use cookies or similar technologies on our websites, subject to applicable law.

1.3 Information from Third Parties.

We may receive information from:

  • Customer-authorized integrations (e.g., identity providers, code hosting systems)
  • Service providers that support the Services (e.g., hosting, security monitoring)
  • Publicly available professional sources to manage enterprise relationships

2. How We Use Information

2.1 Service Delivery. To provide, operate, maintain, secure, and support the Services, including account management, running evaluations, generating deliverables, and responding to support requests.

2.2 Service Improvement. To monitor performance, debug errors, improve reliability and user experience, and develop new features. Where reasonably possible, we use aggregated or de-identified information for analytics.

2.3 Communications. To send administrative, transactional, and security communications. You may opt out of marketing emails using the unsubscribe link or by contacting us.

2.4 Security and Legal Compliance. To detect, prevent, and respond to security incidents, misuse, and illegal activity, and to comply with applicable law.

2.5 Restrictions on Use of Customer Materials. Boolean will use Customer Materials solely to provide the Services and as otherwise permitted in the applicable customer agreement, and not for any other purpose unless expressly authorized in writing.

2.6 No Training of Generalized Models Without Explicit Consent. Boolean does not use Customer Materials (including customer-provided code, datasets, prompts, or model outputs) to train, fine-tune, or otherwise improve generalized machine learning models, except where (i) Customer provides explicit prior written consent and (ii) such use is permitted under a mutually executed written agreement.

3. How We Share Information

We do not sell personal information. We may disclose information as follows:

3.1 Service Providers. With vendors and subprocessors that help us provide the Services (e.g., hosting, security monitoring, payment processing). They are required to protect information and to use it only to provide services to us.

3.2 Human Review. If the Services include human evaluation or review, we may provide limited access to Customer Materials to trained personnel under confidentiality and access controls, only as necessary to provide the Services.

3.3 Compliance and Legal Process. If required by law or valid legal process, or to protect the rights, safety, and security of Boolean, our customers, or others.

3.4 Business Transactions. In connection with a merger, financing, acquisition, or sale of assets, subject to appropriate confidentiality protections.

3.5 At Customer Direction. With Customer's instructions or authorization.

4. Data Security

We maintain technical and organizational measures designed to protect information against unauthorized access, loss, misuse, disclosure, or alteration. These may include access controls, encryption in transit, monitoring, vulnerability management, and least-privilege practices. No method of transmission or storage is completely secure.

5. Data Retention

We retain information for as long as necessary to provide the Services and for legitimate business purposes, including legal compliance and security. Upon Customer's request or termination of the applicable agreement, we will return or delete Customer Materials in accordance with that agreement.

6. International Data Transfers

We may process information in the United States and other jurisdictions. Where required by law, we implement appropriate transfer safeguards (e.g., standard contractual clauses or other lawful mechanisms).

7. Your Rights and Choices

Depending on applicable law, individuals may have rights such as access, correction, deletion, objection or restriction of processing, and data portability. If a request relates to Customer Materials, we will route the request to the applicable customer and assist as required by law.

You may update account information through the Services or by contacting your administrator. You may opt out of marketing emails at any time; we may still send non-marketing messages (e.g., security or transactional notices).

8. Children

The Services are not directed to children, and we do not knowingly collect personal information from children.

9. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date reflects the effective date of the latest revision. Continued use of the Services after an update constitutes acceptance of the updated Policy, where permitted by law.
